  • Disclosures to service providers as defined under applicable law are not considered a sale or sharing
  • Disclosures to advertising or analytics partners for cross-context behavioral advertising may constitute “sharing” under CPRA and similar laws

 

5. Data Retention

We retain Personal Information only for as long as reasonably necessary for the purposes described in this Policy:

  • Customer and transactional data: for the duration of the customer relationship and thereafter as required by law
  • Security and audit logs: up to 24 months
  • Retention periods may be extended where legally required or necessary to establish or defend legal claims.

If we decline to take action on your request, you may appeal our decision by contacting us at datacompliance@phmg.com. We will respond to your appeal within the timeframe required by applicable law.

Global Privacy Control (GPC)

We recognize and honor valid browser‑based Global Privacy Control signals where required by applicable law.

 

10. SMS, Telephone, and Electronic Communications

Where required by law, PHMG obtains prior express consent before sending marketing SMS messages or telephone calls. You may withdraw consent at any time by replying “STOP” to SMS messages or by contacting us.

11. Data Security

We implement reasonable and appropriate administrative, technical, and physical safeguards designed to protect Personal Information, taking into account the nature of the Personal Information and the risks associated with processing it. However, no security safeguards are infallible, and we cannot guarantee absolute security.

California residents may opt out of the sale or sharing of Personal Information by contacting us or by using the “Do Not Sell or Share My Personal Information” link on our website.

Sensitive Personal Information

California residents may limit the use of Sensitive Personal Information to purposes permitted by CPRA.

California Shine‑the‑Light

California residents may request information about disclosures of Personal Information for direct marketing purposes by contacting datacompliance@phmg.com.

Verification

We will verify requests by confirming information associated with the requestor’s account or historical interactions.

 

Appendix B – Additional US State Privacy Rights

Residents of Virginia, Colorado, Connecticut, Utah, Texas, Montana, Oregon, and other applicable jurisdictions may have similar rights, including access, correction, deletion, and opt‑out of targeted advertising.

Requests from these jurisdictions are processed using the same methods and timelines described in Section 9.

Where required by applicable law, residents of these jurisdictions may also have the right to appeal a decision regarding a privacy request, as described in Section 9.

 

Appendix C – Marketing & Advertising Practices

PHMG engages in marketing and advertising activities including:

  • Email marketing
  • Telephone outreach
  • SMS marketing (where consent is obtained)
  • Digital advertising and retargeting

We may use advertising partners and analytics providers to measure campaign effectiveness. Data shared for these purposes may be considered a sale or sharing under CPRA. Individuals may opt out at any time through our privacy rights mechanisms.

 

Appendix D – SMS & Telephony Notice

PHMG SMS programs are voluntary. By opting in, you consent to receive marketing‑related messages. You may withdraw consent at any time by replying STOP.

SMS and telephony communications are governed by the Telephone Consumer Protection Act (TCPA) and applicable carrier requirements.
